Dusk to Dawn Fellowship Bylaws

Preamble

We, the members of Dusk to Dawn Fellowship do ordain and establish the following

Articles (Bylaws) to which we voluntarily and solemnly submit ourselves.

Article 1: Name

 The name of this church shall be Dusk to Dawn Fellowship

Article 2: Purpose

 The purpose of this document is to establish the bylaws of Dusk to Dawn Fellowship, a spiritual organization dedicated to the sacred use of entheogen plants and mushrooms.The mission of this organization is to promote the responsible use of entheogens for spiritual exploration and natural healing, and to provide a safe and supportive community for individuals who share this vision. 

Article 3: Membership

 A. Requirements for Membership

  1. Prospective members must be at least 21 years old and have a sincere interest in the spiritual and healing use of entheogen plants and mushrooms.

  2. Prospective members must complete a membership application and Limited Liability Agreement with Dusk to Dawn Fellowship.

B. Membership Application Process

  1. Prospective members must submit a completed membership application to Dusk to Dawn Fellowship.

  2. Dusk to Dawn Fellowship will review the application and may request additional information or clarification if necessary.

  3. Dusk to Dawn Fellowship will make a decision on the membership application within 7 days of receipt.

C. Termination of Membership

  1. Membership in Dusk to Dawn Fellowship may be terminated for violation of the code of conduct or for other reasons at the discretion of the board.

  2. Members who wish to resign from Dusk to Dawn Fellowship may do so at any time by submitting a written or verbal request to the Church.

Article 4: Leadership and Governance

 A. Roles and Responsibilities of the Governing Board

  1. The governing board of Dusk to Dawn Fellowship is responsible for the overall direction and management of the organization.

  2. The governing board shall consist of at least three members.

  3. The governing board shall have the authority to make decisions on behalf of Dusk to Dawn Fellowship.

B. Requirements for Serving on the Governing Board

  1. Prospective board members must be members in good standing of the Church.

  2. Prospective board members must demonstrate a commitment to the principles and values of the Church.

  3. Prospective board members must be willing and able to fulfill the responsibilities of their respective roles.

C. Procedures for Decision-Making and Conflict Resolution

  1. The governing board shall make decisions by consensus whenever possible.

  2. In the event that consensus cannot be reached, decisions shall be made by a two-thirds majority vote of the governing board.

  3. The Church shall have a process for resolving conflicts between members or with external parties, which may include mediation, arbitration, or other forms of dispute resolution.

Article 5: Spiritual Practices and Services

 A. Description of Entheogenic Sacraments

  1. Dusk to Dawn Fellowship recognizes the spiritual value of entheogen plants and  psilocybin-containing mushrooms.

  2. Dusk to Dawn Fellowship believes that the responsible use of these entheogenic sacraments can facilitate spiritual exploration, healing, and personal growth.

B. Guidelines for Safe and Responsible Use of Entheogenic Sacraments

  1. Dusk to Dawn Fellowship shall establish guidelines for the safe and responsible use of entheogenic sacraments, which may include guidelines for dosage, set and setting, and integration.

  2. Dusk to Dawn Fellowship shall provide education and training to its members on the safe and responsible use of entheogenic sacraments.

  3. Dusk to Dawn Fellowship shall have a policy of zero tolerance for the use of entheogenic sacraments by minors or by individuals who are not members of the Church.

C. Procedures for Conducting Entheogenic Spiritual Practices

  1. Dusk to Dawn Fellowship shall establish procedures for conducting entheogenic spiritual practices, which may include guidelines for the selection and training of support facilitators, preparation of participants, and integration.

  2. Dusk to Dawn Fellowship shall ensure that all practices are conducted in a safe and supportive environment.

D. Requirements for Those Who Lead or Facilitate

  1. Those who facilitate entheogenic practices must be members in good standing of the Church. 

  2. Those who facilitate must have completed appropriate training and demonstrated a thorough understanding of the principles and values of the Church.

  3. Those who facilitate must adhere to the guidelines and procedures established by the Church for the safe and responsible use of entheogenic sacraments.

Article 6: Community Standards

 A. Code of Conduct for Members of Dusk to Dawn Fellowship

  1. Members of the Church shall adhere to a code of conduct that promotes respect, integrity, and responsibility.

  2. The code of conduct shall prohibit behaviors that are harmful to individuals or the community, including but not limited to violence, discrimination, and harassment.

B. Procedures for Addressing Violations of the Code of Conduct

  1. The Church shall establish procedures for addressing violations of the code of conduct, which may include investigation, mediation, and disciplinary action.

  2. The Church shall ensure that all members are aware of the code of conduct and the consequences of violating it.

C. Guidelines for Respectful Communication and Conflict Resolution

  1. The Church shall promote respectful communication and conflict resolution among its members, and shall establish guidelines for resolving conflicts in a constructive and respectful manner.

Article 7: Legal Compliance

 A. Explanation of the Dusk to Dawn Fellowship’ Legal Status and Protections

  1. Dusk to Dawn Fellowship shall maintain compliance with all relevant laws and regulations, and shall provide education and training to its members on legal compliance.

  2. Dusk to Dawn Fellowship shall seek to establish legal protections for the religious use of entheogenic sacraments, including but not limited to exemptions from drug laws and protections under the First Amendment of the U.S. Constitution, the federal Religious Freedom Restoration Act of 1993, and other applicable state laws..

B. Procedures for Complying with Relevant Laws and Regulations

  1. Dusk to Dawn Fellowship shall establish procedures for complying with relevant laws and regulations, which may include reporting requirements, record keeping, and compliance with health and safety regulations.

  2. Dusk to Dawn Fellowship shall ensure that all members are aware of their legal obligations and the consequences of non-compliance.

Article 8: Finances

 A. Explanation of How Dusk to Dawn Fellowship is Funded

  1. Dusk to Dawn Fellowship shall be funded through donations, grants, and other contributions for sacrament to Dusk to Dawn Fellowship from its members and supporters.

  2. Dusk to Dawn Fellowship shall maintain financial transparency and accountability.

B. Procedures for Managing and Reporting Financial Transactions

  1. Dusk to Dawn Fellowship shall establish procedures for managing and reporting financial transactions, which may include guidelines for budgeting, accounting, and financial reporting.

  2. Dusk to Dawn Fellowship shall ensure that all financial transactions are conducted in a transparent and accountable manner, and that all expenditures are consistent with the mission and values of the church.

 

Article 9: Amendments and Dissolution

 A. Procedures for Amending the bylaws

  1. These bylaws may be amended by a two-thirds vote of the governing board members present at a meeting of the Church.

  2. Proposed amendments must be provided to the members before the meeting at which the vote will be taken.

B. Procedures for Dissolving Dusk to Dawn Fellowship

  1. The Church may be dissolved by a unanimous vote of the governing board members present at a meeting of the church.

  2. Upon dissolution, all assets of the Church shall be distributed in accordance with its stated mission and values, or as otherwise required by law.

Article 10: Adoption of These Bylaws

 The bylaws shall be adopted upon approval by a two-thirds vote of the members present at a meeting of the Church. The bylaws shall be effective immediately upon adoption.
